Terms of Use

These are the basic terms for using Cannes while the app is still small and evolving.

Using Cannes

Cannes is a small app for discovering movies and TV, creating watchlists, and tracking what you want to watch or have watched. By using Cannes, you agree to these Terms.

You are responsible for your account and for activity that happens through it. Keep your login details secure and use accurate account information.

Acceptable Use

We may suspend or remove accounts or content that violate these Terms or create risk for Cannes or other users.

  • Do not abuse, disrupt, or probe the service.
  • Do not scrape, reverse engineer, or bypass access controls.
  • Do not upload unlawful, infringing, or harmful content.
  • Do not impersonate others or misuse public/profile features.

Your Content

You keep ownership of content you submit to Cannes, such as profile details, avatars, and watchlist content. You give us a limited license to host, store, copy, and display that content as needed to operate the service.

If you choose to make profile details or watchlists public, you understand that other people may be able to see them.

User-Generated Content

Users are solely responsible for the content they submit to Cannes. Cannes does not endorse, control, verify, or guarantee user-generated content, and to the maximum extent permitted by law we are not responsible or liable for that content or for any loss or damage resulting from your reliance on it.

We may, but do not have to, monitor, review, screen, edit, remove, or restrict user-generated content at any time and for any reason.

Third-Party Services

Cannes relies on third-party providers and data sources, including authentication providers and movie or TV metadata providers. We are not responsible for third-party services, their uptime, or their separate terms and policies.

Disclaimers and Liability

Cannes is provided on an "as is" and "as available" basis. We do not guarantee that the service will always be uninterrupted, secure, or error-free, or that third-party data will always be complete or accurate.

To the maximum extent permitted by law, Cannes will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the service.

Dispute Resolution and Arbitration

Before starting a formal dispute, you agree to email a short description of the issue to [email protected] and try to resolve it informally with us first.

Except for disputes that can be brought in small claims court, disputes arising out of or relating to Cannes or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The Federal Arbitration Act will govern the interpretation and enforcement of this arbitration provision.

If the arbitration provider declines to administer the dispute, either party may bring the dispute in a court of competent jurisdiction.

Class Action Waiver

You and Cannes agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, mass, or representative proceeding.

Unless applicable law requires otherwise, the arbitrator may not consolidate claims from more than one person and may not preside over any class or representative proceeding. If this waiver is found unenforceable as to a particular claim or remedy, that claim or remedy must be resolved in court and not in arbitration, and the rest of this section will remain in effect.

Indemnity

You agree to defend, indemnify, and hold harmless Cannes and its affiliates, officers, directors, employees, contractors, and service providers from claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your misuse of the service, your violation of these Terms, or your violation of applicable law or another person's rights.

Termination

You may stop using Cannes at any time. We may suspend, limit, or terminate your access to Cannes at any time, with or without notice, if we believe you violated these Terms, created risk for the service or other users, or if we decide to change or stop offering the service.

Termination will not limit any rights or remedies that accrued before termination.

Delaware Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute relating to these Terms or the service should be brought in the state or federal courts located in Delaware, except where mandatory consumer-protection law says otherwise.

Survival

The sections on Your Content, Disclaimers and Liability, Dispute Resolution and Arbitration, Class Action Waiver, Indemnity, Delaware Law, and any provisions that by their nature should survive will survive any termination or suspension of your use of Cannes.

Changes and Contact

We may update these Terms from time to time. If you continue using Cannes after changes take effect, that continued use means you accept the updated Terms.
